Litigation in Mexico

Lets face it: Nobody likes to go to court, but sometimes you are left with no choice than to fight for what you are entitled to under the Law.

Though we believe in pursuing settlement by way of negotiation, or mediation, somes cases require aggressively pursuing a matter with the Mexican Courts.

At Osuna and associates we have over 15 years experience dealing with complex litigation in Civil and Commercial Cases, involving a broad range of topics: from commercial contracts involving intellectual property, to real estate contract disputes, to tort litigation.

Our experience also includes litigating cases at the appellate level, and to the Mexican Circuit Courts in cases of "amparo" appeals.

 

A bit of Information on the Structure of Mexican Courts.

The Mexican Court System consists of State and Federal Courts.

State Courts are divided in Courts of First Instance (trial level), and appellate Courts which is typically the State Superior Court. Even after a case is decided at the appellate level, a case can still end up in a Federal Circuit Court for review.

Federal Courts are structured similarly, but dedicate most of their efforts in Federal Injunction Cases (amparo) deciding issues of constitutionality, or Federal Criminal Cases. Still, they have concurring jurisdiction --along with State Courts-- in Commercial Matters.

On appeal, the Mexican Federal Courts decisions are reviewed by a single appellate judge. If the case involves a Federal injunction case, the review will be by a panel of Three Judges sitting on a Circuit Court.

  • Participated as co-counsel in case involving a major US hamburguer chain in a dispute with a Mexican franchisee.


  • Obtained first documented Mexican decision involving the application of the Vienna Sales Convention on the Sale of Goods.


  • Has represented dozens of US Citizens in disputes involving property acquisitions in Mexico.
